What Is IRC 2024 and Why Does It Apply to Your Basement?

International Residential Code · Section R310 · Emergency Escape and Rescue Openings

The International Residential Code (IRC) is the model building code published every three years by the International Code Council (ICC) that governs the construction, alteration, and repair of residential buildings across the United States. The 2024 edition is the current published standard, though individual states adopt specific editions on their own timelines — meaning your local jurisdiction may be enforcing the 2021, 2018, or even earlier edition — see which edition your state currently enforces..

Section R310 is the specific part of the IRC that governs emergency escape and rescue openings — what most homeowners, contractors, and real estate agents know as “egress windows.” The code’s purpose is straightforward: every habitable basement room must have an opening large enough for a person to escape through in an emergency and large enough for a firefighter to enter through for rescue.

Important: The IRC is a model code, not a federal law. Always check which edition your state enforces and whether any local amendments apply. When in doubt, call your municipality before purchasing or installing. Our team at 1-877-534-7377 fields these questions every day and can help you navigate local requirements.

When Does Section R310 Apply?

IRC 2024 Section R310.1 states that basements, habitable attics, and every sleeping room shall have not less than one operable emergency escape and rescue opening. Where basements contain one or more sleeping rooms, an emergency escape and rescue opening is required in each sleeping room. This is one of the most misunderstood aspects of the code — it is per bedroom, not per basement.

The 4 Required Dimensions (Section R310.2)

IRC 2024 · Section R310.2.1 through R310.2.4 · Net Clear Opening

IRC 2024 establishes four specific dimensional requirements for every emergency escape and rescue opening. All four must be met simultaneously — satisfying three out of four is still a code violation. The critical phrase in the code is “net clear opening” — this refers to the actual usable opening when the window is fully open, not the frame size, not the glass area, and not the rough opening in the wall.

Grade Floor Exception (R310.2.1): For windows at or near grade level where the finished floor and the adjacent ground elevation are within 44 inches of each other, the minimum net clear opening area is reduced to 5.0 square feet instead of 5.7. This exception rarely applies to basement installations.

Understanding "Net Clear Opening"

Net clear opening is one of the most misunderstood concepts in egress code. It is not the size of the window frame, the glass pane, or the rough opening cut in the foundation wall. It is the actual unobstructed space a person can pass through when the window is in its fully open position.

For a tilt-turn egress window, the net clear opening equals approximately the full glass area because the sash swings completely out of the way. For a slider window, the net clear opening equals roughly half the glass area because the other half is always blocked by the fixed sash — this is why slider windows must be sized larger to achieve the same 5.7 sq ft net clear opening. For a single-hung window, even less than half the area is usable for egress.

Every EgressUSA Egress Pros window meets all four R310.2 dimensional requirements. Every kit includes our sizing guide and net clear opening specs for each model so you know exactly what to show your building inspector. Every kit includes our sizing guide and net clear opening specs for each model so you know exactly what to show your building inspector.

Operational Requirement (R310.1.1)

The code also requires that emergency escape and rescue openings be operational from the inside without the use of keys, tools, or special knowledge. A window that requires a key or special latch to open does not qualify even if it meets all dimensional requirements. The Egress Pros sliding screen system is specifically engineered for this — one motion, no tools, no obstruction, fastest escape path available.

Window Well Requirements (Section R310.4)

IRC 2024 · Section R310.4.1 through R310.4.4 · Area Wells

When an egress window opening is below the adjacent ground elevation — which is the case in virtually every basement installation — IRC 2024 Section R310.4 requires a window well. The well creates the clear space in front of the window that allows the opening to be fully used for escape or rescue. A window well that’s too small or too shallow can cause your installation to fail inspection even if the window itself meets all four R310.2 requirements.

Minimum 9 Square Feet Floor Area

The horizontal area of the window well must be at least 9 square feet. This ensures a person can stand in the well and maneuver to climb out.

Minimum 36-Inch Width & Projection

The well must have a horizontal projection of at least 36 inches from the foundation wall and a width of at least 36 inches. Both dimensions must be met.

Allow Full Window Opening

The size of the well shall allow the emergency escape and rescue opening to be fully opened. The well cannot obstruct the window from reaching its maximum open position.

Ladder Required if Well Depth Exceeds 44"

If the vertical depth of the well from the adjacent ground to the bottom of the well exceeds 44 inches, a permanently affixed ladder or steps is required.

All Boman Kemp window wells sold by EgressUSA meet the 9 sq ft minimum area and 36-inch projection requirements — shop Boman Kemp window wells →

IRC 2024 Section R310.4 — Window Well Requirements
Side view & top view

Don't confuse well depth with sill height. The 44-inch ladder trigger is measured from the bottom of the window well excavation to the adjacent ground level — not from the finished floor to the sill. A basement with a sill at 40 inches can still have a well depth of over 44 inches if the excavation is deep. Always measure both.

Window Well Materials

IRC 2024 does not mandate specific materials for window wells, but requires they be durable and capable of withstanding the soil pressure of the surrounding excavation. Accepted materials include rust-resistant metal, treated wood, wood naturally resistant to decay, concrete, masonry, and plastic. All Boman Kemp window wells sold through EgressUSA are manufactured from heavy-gauge steel or high-density poly and are engineered to meet these requirements.

Ladder and Steps Requirements (Section R310.4.2)

IRC 2024 · Section R310.4.2 · Area Well Ladders

When a window well has a vertical depth greater than 44 inches, IRC 2024 Section R310.4.2 requires a permanently affixed ladder or steps that can be used with the window in its fully open position. The ladder cannot be obstructed by the open window — it must be accessible for use during the emergency escape.

Ladder Specification IRC 2024 Requirement Notes
Inside width of rungs
✓ Minimum 12 inches
Measured between the side rails at each rung
Projection from wall
✓ Minimum 3 inches
Rungs must protrude at least 3″ to provide grip
Maximum rung spacing
✓ 18 inches on center
Vertical spacing for full height of well
Encroachment into well area
Maximum 6 inches
Ladder may encroach up to 6″ into required 9 sq ft well area
Must not obstruct window
✓ Required
Ladder position must allow full window opening
Permanently affixed
✓ Required
Cannot be removable — must be permanently attached to the well

Hook-mount ladders qualify. IRC 2024 does not require the ladder to be bolted through the well wall. Permanently affixed hook-mount ladders — like the Boman Kemp egress ladder — hook over the top of the well frame and are considered permanently affixed under the code because they cannot be removed without deliberate effort. All EgressUSA egress ladders meet these specifications.

EgressUSA includes the correct ladder automatically matched to your well depth in every complete egress window kit.

Covers, Grates & Bars Over Egress Openings (Section R310.1.1)

IRC 2024 · Section R310.1.1 · Operational Constraints

IRC 2024 permits bars, grilles, covers, screens, or similar devices to be placed over emergency escape and rescue openings and window wells — but only under specific conditions. The key requirement is that such devices must be releasable or removable from the inside without the use of a key, tool, special knowledge, or force greater than that which is required for normal operation of the escape opening.

This means a polycarbonate well cover, a steel grate, or even window bars are all code-compliant as long as anyone inside the room — including a child — can open or remove the cover from inside without any tools in an emergency. All covers sold by EgressUSA meet this requirement. Covers with padlocks or exterior-only release mechanisms do not comply regardless of how they are installed.

All EgressUSA polycarbonate covers and steel grates are designed to be opened from the inside with a single upward or outward motion — no tools, no keys, no special effort. Compliant with R310.1.1 out of the box.

Which Window Styles Qualify as Egress Windows?

IRC 2024 · Section R310.2 · Window Type Comparison

IRC 2024 does not mandate a specific window style — any operable window style that achieves the required net clear opening dimensions qualifies. However, different window styles have very different efficiencies when it comes to turning overall window size into net clear opening area. This matters because the smaller the rough opening you can cut in your foundation wall, the less structural work is required.

Best for Egress
Most Efficient

Opens inward — tilts from top for ventilation, turns fully from side for emergency exit. Nearly 100% of glass area becomes net clear opening. The Egress Pros tilt-turn is the highest-quality option available, featuring a sliding screen for instant emergency escape.

IRC Compliant
Wide Opening

Slides horizontally. Net clear opening equals approximately half the total window area, so a larger frame is required. Best choice when wall depth or low ceiling height prevents inward-opening windows. Egress Pros sliders available in white & black with sliding screens.

Least Efficient

Only the bottom sash opens, providing less than half the total area as net clear opening. Requires very large frames to meet 5.7 sq ft requirement. Rarely the best choice for basement egress. Not carried by EgressUSA.

Net Clear Opening Efficiency by Window Style
Why tilt-turn is most efficient for egress

Why Egress Pros windows are the best choice: Standard egress windows require you to push a screen out of the way before you can exit in an emergency. Egress Pros windows feature a sliding screen that moves instantly out of the opening with one motion — giving you and your family the fastest possible exit. In a fire, seconds matter. It is the only egress window on the market engineered specifically around emergency escape speed.

Permits, Inspections & Local Code Adoption

Building Permits · Local Amendments · Final Inspection

Installing an egress window involves cutting through a structural foundation wall. In virtually every U.S. jurisdiction, this requires a building permit before work begins. Working without a permit creates serious risk — the work may need to be torn out and redone, your homeowner’s insurance may be voided, and the installation may not be recognized as compliant at the time of sale.

number 1 icon
Contact Your Local Building Department

Call or visit your municipality's building department before purchasing. Ask which IRC edition they enforce, whether they have local amendments, and what you need to submit for a permit application.

number 2 icon
Submit Your Permit Application

Most jurisdictions require a site plan showing the window location, the window's net clear opening dimensions, and the contractor's license number. EgressUSA kits include full specification sheets for submission.

number 3 icon
Install After Permit is Approved

Do not begin cutting until the permit is issued and posted. Foundation cutting should be done by a licensed contractor with masonry experience. Most installations are completed in one day.

number 4 icon
Schedule Your Inspection

After installation, schedule a building inspection. The inspector will verify that the window, well, and ladder (if required) meet all four R310.2 dimensional requirements. EgressUSA kits are engineered to pass first inspection.

Which IRC Edition Does My State Use?

The IRC is a model code — states and municipalities adopt specific editions on their own schedule. As of 2025, most states have adopted the 2018, 2021, or 2024 edition. The core egress requirements in Section R310 are largely consistent across all recent editions, but local amendments can add stricter requirements in some jurisdictions. California, New York, and Massachusetts in particular frequently have additional provisions. Always verify with your local building department.

Never skip the permit. Unpermitted egress work is one of the most common issues flagged during home sales inspections. If a buyer's inspector finds unpermitted egress windows, it can kill the deal, require expensive removal and redo, and may affect your homeowner's insurance coverage retroactively.

Need a licensed installer to handle the permit process for you? EgressUSA matches you with a certified local installer — typically within one business day.

IRC 2024 Code Exceptions You Should Know

IRC 2024 · Section R310.1 · Exceptions

IRC 2024 Section R310.1 includes several specific exceptions to the egress window requirement. These are narrow and often misunderstood — they do not provide broad exemptions and apply only in very specific circumstances.

Exception What It Allows Conditions Required
Sprinkler System
Sleeping rooms in basements may not need egress windows
Dwelling must have automatic sprinkler system per Section P2904, AND basement must have either one egress opening + one means of egress, OR two means of egress
Mechanical Room
No egress window required
Basement used exclusively to house mechanical equipment and not exceeding 200 sq ft total floor area
Replacement Windows
Replacement windows in existing openings may not need to meet new dimensional requirements
Must be largest standard size that fits existing frame OR same operating style with equal or greater opening area. Not part of change of occupancy.
Grade Floor Exception
Minimum opening area reduced to 5.0 sq ft
Window is at grade floor level where finished floor and adjacent ground are within 44 inches of each other

The sprinkler exception is narrower than most people think. Having sprinklers does not automatically exempt you from egress requirements — you still need either a compliant egress window or two separate means of egress. If in doubt, install the egress window. It is always safer and typically adds more home value than the cost of installation.

Consequences of Non-Compliance

Legal · Financial · Safety · Real Estate

Non-compliance with IRC 2024 Section R310 is not just a technicality. It carries real legal, financial, and personal safety consequences that affect homeowners, landlords, and buyers in very concrete ways.

How to Measure for an IRC 2024 Compliant Egress Window

Rough Opening · Net Clear Opening · Well Depth · Sill Height

Before ordering, take four measurements. Bring these to our team at 1-877-534-7377 and we can recommend the right kit for your specific installation.

letter A icon
Rough Opening Width

Measure the width of the existing opening in your foundation wall, or the maximum width you can cut. This determines which window models will physically fit your installation.

letter b icon
Rough Opening Height

Measure from the top of the window well floor to the top of the available opening height. Remember that the net clear opening will be slightly smaller than the rough opening after the frame is installed.

letter c icon
Sill Height from Finished Floor

Measure from the finished floor to the bottom of the window opening. This must not exceed 44 inches. If it does, the window opening will need to be raised or extended downward.

letter d icon
Well Depth from Grade

Measure from the top of the adjacent ground to the bottom of your window well excavation. If this exceeds 44 inches, a permanently affixed ladder is required by code.

Not sure about your measurements? Call us at 1-877-534-7377 before ordering. Our team can walk you through the measuring process, confirm which kit will work for your specific opening, and help you understand exactly what to tell your building inspector. This call is free and takes about 10 minutes.

IRC 2027 — What's Currently in Development and What It Means for Egress Windows

ICC 2024–2026 Development Cycle · Group B Hearings 2025 · Final Vote 2026 · Publication Late 2026

The International Code Council publishes a new IRC edition every three years. IRC 2024 is the current standard — but the 2027 edition is already being developed through an active cycle of hearings, proposals, and votes running from 2024 through late 2026. Here’s exactly where things stand, what’s proposed for egress windows specifically, and what it means for your project.  Check the current edition your state enforces — most states are still on 2018 or 2021 as of 2026.

The most important thing to know: The four core egress dimensions — 5.7 sq ft minimum opening, 24-inch minimum height, 20-inch minimum width, 44-inch maximum sill height — are not proposed for change in IRC 2027. They have been stable since IRC 2012 and remain unchanged. Any kit that meets IRC 2024 will continue to meet IRC 2027.

State Adoption (Lagged)

IRC 2027 will be published but enforcement depends on state adoption. Based on current patterns, most states won't enforce 2027 until 2029–2031. Many states are still on 2018 or 2021.

What's Actually Proposed for Egress Windows in IRC 2027

The egress window industry — for the first time in several code cycles — was actively involved in the 2027 proposals. Leaders from several manufacturers presented three proposals specifically addressing Section R310. The most significant involves how window well area is measured.

The current IRC requires a 3-foot by 3-foot area (9 sq ft) inside the window well. The problem is that few manufactured window wells actually provide a true 3×3 square footprint — steel and plastic wells are typically curved or oval to better resist soil pressure from the surrounding excavation. A curved well from Bilco, Boman Kemp, or similar manufacturers provides the required 9 sq ft of area, but not in a strict 3×3 square. The proposed change would adjust how the space is measured to better align with the actual shape of manufactured wells, eliminating a gray area that has caused inconsistent interpretation by building inspectors across the country.

What this means for EgressUSA customers:All Boman Kemp window wells sold through EgressUSA already meet the 9 sq ft minimum area requirement. The proposed 2027 change would clarify measurement methodology — it would not require a larger well or any additional components. Our kits will continue to meet the requirement as written under both 2024 and any 2027 language.

Other Notable 2027 Proposals That May Affect Egress

IRC 2027 Development & Adoption Timeline
Proposal What It Would Change Impact on Egress
Window well area measurement
Adjusts how the 9 sq ft well area is measured to accommodate curved manufactured wells
✓ Clarification only — no size increase
IRC scope expansion to 3–4 unit dwellings
Would bring triplexes and quadplexes under IRC (currently IBC)
Indirect — more buildings need egress
Stair riser height restoration
Proposal to restore 8¼” riser height and 9″ tread depth
Not related to egress windows
Flood design requirements expansion
Would expand to 500-year floodplain requirements
May affect window placement in flood zones
Core R310 dimensions
5.7 sq ft, 24″, 20″, 44″ — no changes proposed
✓Unchanged since IRC 2012

Why IRC 2027 Won't Affect Most Projects Until 2029 or Later

Even when the ICC finalizes and publishes IRC 2027 in late 2026, it becomes law only when your state formally adopts it. Based on historical adoption patterns, most states take two to five years to adopt a new IRC edition after publication. As of May 2026, many states are still enforcing IRC 2018 — and several are only now transitioning to 2021.

This means the practical reality for most homeowners and contractors today is: IRC 2024 is the edition to design and build to. It’s the most current published standard, the edition most aggressively being adopted by progressive states, and the edition that EgressUSA kits are verified against. A kit that meets IRC 2024 will automatically meet IRC 2027 because the core egress dimensions are not changing.

Bottom line for EgressUSA customers: Buy the compliant kit today. IRC 2027 will not change the four dimensions you need to meet. The proposed well measurement clarification benefits installers — it doesn't add new requirements. Every kit we sell now will remain fully compliant when your state eventually adopts IRC 2027. We'll update this guide as the final 2027 language is published.

Frequently Asked Questions

IRC 2024 Egress Window FAQ — Answers for Homeowners, Landlords & Contractors

IRC 2024 Section R310 requires every basement sleeping room to have an emergency escape and rescue opening meeting all four of these criteria simultaneously: (1) minimum 5.7 square feet net clear opening area, (2) minimum 24-inch clear height, (3) minimum 20-inch clear width, and (4) maximum 44-inch sill height above the finished floor. The window must also be operable from the inside without keys, tools, or special knowledge, and must be at least 5.0 sq ft if at grade level.

Yes. IRC 2024 Section R310.1 is explicit: “Where basements contain one or more sleeping rooms, an emergency escape and rescue opening shall be required in each sleeping room.” One egress window in a hallway or common area does not satisfy the requirement for a bedroom. Each bedroom needs its own dedicated egress window.

Net clear opening is the actual unobstructed space available for exit when the window is in its fully open position. It is not the frame size, the glass size, or the rough opening cut in the wall. For a tilt-turn window that swings fully open, net clear opening is approximately equal to the glass area. For a slider where half the frame is always fixed, net clear opening equals roughly half the glass area — which is why sliders must be sized larger.

You can install a cover, grate, or screen over the window or window well as long as it is releasable or removable from the inside without keys, tools, special knowledge, or unusual force. A polycarbonate cover that lifts off from inside is compliant. A padlocked steel grate or a cover with exterior-only release is not. All covers sold by EgressUSA are designed to meet this requirement.

In the vast majority of U.S. jurisdictions, yes. Installing an egress window requires cutting through a structural foundation wall, which almost universally triggers a building permit requirement. Working without a permit creates risk of expensive redo work, insurance voidance, and complications at home sale. Always contact your local building department before starting.

Possibly not for sleeping rooms specifically — but only if your sprinkler system complies with Section P2904 AND your basement also has either one means of egress plus one emergency escape opening, or two separate means of egress. The sprinkler exception is narrow. Having sprinklers alone does not automatically eliminate the egress requirement. Verify with your local building department.

If your basement was built with a compliant egress window under the code at the time of construction, it is typically grandfathered and does not need to be retrofitted to meet 2024 dimensions. However, if your basement bedroom was built without any egress window — or with a non-compliant one — a buyer’s inspector will flag it and it may not qualify as a bedroom on the MLS listing, affecting your sale price and timeline. This is one of the most common issues flagged in pre-sale home inspections.

A tilt-turn window opens inward in two modes — tilting from the top for ventilation and swinging fully open from the side for emergency escape. Because the sash swings completely clear, nearly all of the glass area becomes usable net clear opening — making it the most efficient style for egress. The Egress Pros tilt-turn also features a sliding screen that moves instantly out of the way for the fastest possible emergency exit. A slider window slides horizontally and only half the window area becomes net clear opening, so larger frames are needed to meet the 5.7 sq ft requirement. Sliders are preferred when wall depth or ceiling height prevents an inward-opening window.

Most real estate agents and appraisers follow a combination of local MLS guidelines and IRC/building code requirements. The standard checklist typically includes: egress window meeting code dimensions, minimum ceiling height (usually 7 feet), minimum room size (varies by jurisdiction, typically 70–80 sq ft), a closet (in some markets), and heating. The egress window is almost always the first item checked because it is the most commonly missing requirement in basement bedrooms.

No. The four core egress dimensions — 5.7 sq ft minimum opening, 24-inch minimum height, 20-inch minimum width, and 44-inch maximum sill height — are not proposed for change in the IRC 2027 development cycle. They have been stable since IRC 2012. The main egress-related proposal in 2027 is a clarification of how window well area is measured to better accommodate curved manufactured wells — it does not increase the required size. Any EgressUSA kit purchased today will remain fully compliant when your state eventually adopts IRC 2027.

The ICC is expected to publish IRC 2027 in late 2026 following Public Comment Hearings and a governmental vote. However, publication does not make it law — each state must formally adopt it. Based on historical patterns, most states take two to five years after publication to adopt a new edition. Many states are still enforcing IRC 2018 as of 2026. For most projects today, IRC 2024 is the correct edition to design to. Always verify with your local building department which edition is currently enforced in your jurisdiction.
