Egress Window Requirements by State — Which Code Does Your State Enforce?

The International Residential Code (IRC) is a national model standard — but each state adopts its own edition on its own timeline and may add local amendments that change the rules. Some states enforce IRC 2024, others are still on 2018, and some leave it entirely to local jurisdictions. Find your state below and verify exactly what applies to your project.

Always verify with your local building department. Code adoption data changes frequently. This table reflects our best research as of May 2026. Local jurisdictions often have amendments that differ from the statewide standard — and some states give home-rule authority to cities and counties. This information is provided for general guidance only. Call us at 1-877-534-7377 with questions about your specific project.

How IRC Code Adoption Works

Why your state may not be on the same edition as your neighbor

The Model Code vs. Your Local Law

The International Code Council (ICC) publishes a new edition of the International Residential Code every three years — 2018, 2021, 2024, and so on. But publishing a new edition does not make it law anywhere. Each state must go through its own legislative or regulatory process to formally adopt an edition, and that process can take two to five years after the ICC publishes.

This is why, as of 2026, some states are enforcing IRC 2024 while others are still on 2018. Both are using the IRC — just different vintages. For egress windows specifically, the good news is that the core four R310 requirements have not changed since IRC 2012 — 5.7 sq ft, 24″ height, 20″ width, 44″ sill — so a kit that meets 2024 meets all earlier editions automatically.

State vs. Local: Which One Applies?

Even in states with a statewide code, local jurisdictions often have authority to amend it. Cities like New York City, Chicago, Los Angeles, and San Francisco enforce their own locally developed codes that may be stricter than the state standard. In states like Texas, Missouri, and Wyoming, there is no statewide residential code at all — every city and county sets its own rules.

The safest approach is always to contact your local building department before purchasing. Ask two questions: (1) which edition of the IRC are you currently enforcing? and (2) do you have any local amendments that affect egress window requirements? Our team at 1-877-534-7377 can help you interpret the answers.

Major Cities With Their Own Codes

These cities enforce locally developed codes that differ from their state standard. Always verify directly with the city building department.

New York City

New York
NYC Building Code
NYC enforces its own building code based on IBC rather than IRC. Different dimensional requirements and extensive local amendments. Verify with NYC Dept of Buildings.

Chicago

Illinois
Chicago Building Code
Chicago has its own building code. Illinois has no statewide residential code — Chicago and other IL cities set their own requirements independently.

Los Angeles

California
IRC 2024 + LA Amendments
California state code (IRC 2024 based) applies with additional LA County amendments. Los Angeles city and county may differ — verify with LA County DPW or LA City DBS.

San Francisco

California
SF Building Code
San Francisco does not adopt the California Residential Code. SF has its own building code with unique amendments. Verify directly with SF Dept of Building Inspection.

Denver

Colorado
IRC 2021 (Denver)
Denver enforces IRC 2021. However, Colorado has no statewide code — other Colorado cities set their own requirements. Always verify with your specific city.

Houston / Austin

Texas
IRC 2024 (Austin/SA)
Texas has no statewide code. Austin and San Antonio have adopted IRC 2024. Houston has limited code enforcement. Always verify with your specific Texas city.

Philadelphia

Pennsylvania
PA UCC (IRC 2018)
Pennsylvania’s Uniform Construction Code applies statewide including Philadelphia. Based on IRC 2018 with PA amendments.

Boston

Massachusetts
MA 9th Ed. (IRC 2018)
Massachusetts enforces its own 9th Edition Residential Code based on IRC 2018. Significant state-specific amendments apply. Verify with MA BBRS or local building official.

The Good News: Core Egress Dimensions Haven't Changed Since 2012

Regardless of which IRC edition your state enforces, these four R310 requirements have remained consistent since IRC 2012. Every EgressUSA kit meets all four — and is therefore compliant in every state, regardless of which edition is locally enforced.

Frequently Asked Questions

State egress code questions answered by the EgressUSA team

Yes. While the IRC sets the national model standard, each state adopts its own edition on its own timeline. As of 2026, some states enforce IRC 2024 while others are on 2021, 2018, or even earlier. A few states have no statewide residential code and leave enforcement to local jurisdictions. Always verify with your local building department before purchasing or installing.

As of May 2026, states that have adopted IRC 2024 include California, Georgia, Idaho, Iowa, Maryland, Mississippi, Nevada, New York, and North Dakota, along with select jurisdictions in Texas. More states are expected to adopt 2024 through 2026 and 2027. The ICC maintains the most current adoption database at iccsafe.org/adoptions.
The core four dimensions — 5.7 sq ft minimum opening, 24-inch minimum height, 20-inch minimum width, 44-inch maximum sill height — have been consistent across all IRC editions from 2012 onward. This means an EgressUSA kit verified to IRC 2024 automatically meets the requirements of all states using IRC 2018, 2021, or any other recent edition. Some states have local amendments that add stricter requirements in specific areas — always verify locally.
In states without a statewide residential code — including Illinois, Missouri, Montana, Nebraska, Texas (most areas), Wyoming, and Arizona — you must contact your specific city or county building department. Most municipalities in these states have adopted some version of the IRC locally, but the edition varies by city. Your local building official can tell you exactly which code is in effect and whether a permit is required.
Yes. EgressUSA ships free to all 48 continental states with no minimum order. Every kit is pre-verified to IRC 2024, which meets or exceeds the requirements of all previous IRC editions. Whether your state is on 2024, 2021, or 2018, our kits are designed to pass your local building inspection on the first visit — guaranteed.
New York City enforces the New York City Building Code, which is a locally developed code based on the International Building Code (IBC) rather than the IRC. It has different provisions and more extensive amendments than New York State’s residential code. If your project is within the five boroughs of NYC, you must verify requirements specifically with the NYC Department of Buildings — not the New York State code.
The most reliable method is to call your local building department directly and ask: “Which edition of the IRC are you currently enforcing for residential construction, and do you have any local amendments to Section R310 for egress windows?” You can also check the ICC’s code adoption database at iccsafe.org/adoptions, which is updated regularly. For New York, California, Massachusetts, and a few other states with heavily amended codes, you’ll want to verify the state-specific code document as well.
